Terms of service
1. About Us and Scope of These Terms
These Terms and Conditions ("Terms") govern the sale of goods by us to you as a consumer. Please read them carefully before placing an order.
Seller details:
- Trading name: Furnivo
- Address: Princes Street, Edinburgh, EH1 1BE, United Kingdom
- Email: contact@furnivo.shop
- Telephone: 447447205992
By placing an order through our website (furnivolab.myshopify.com), you agree to be bound by these Terms. If you do not agree, please do not place an order. These Terms, together with our Privacy Policy and Returns & Refunds Policy, constitute the entire agreement between you and us.
These Terms apply only to consumer sales. If you are a business customer purchasing goods for resale or commercial use, different terms may apply; please contact us before placing your order.
We reserve the right to update or amend these Terms from time to time. The version in force at the time you place your order will govern that contract. We recommend you download or print a copy of these Terms for your records.
2. How the Contract Is Formed (Order Process)
The process for forming a contract with us is as follows:
2.1 Your Order Is an Offer
When you place an order through our website, you are making an offer to buy the goods you have selected. Your order constitutes an offer to purchase, but does not, by itself, create a binding contract.
Before you submit your order, you will have the opportunity to review your shopping basket, check the goods, quantities and prices, and correct any errors. Please check your order carefully before confirming it.
By clicking the final "Place Order" or "Complete Purchase" button (or similar), you confirm that:
- All information you have provided (including delivery address, contact details and payment information) is true, accurate and complete;
- You are at least 18 years of age or, if under 18, have obtained parental or guardian consent to purchase;
- You are authorised to use the payment method provided; and
- You agree to be bound by these Terms.
2.2 Order Acknowledgement
Once you have placed your order, you will receive an automated email acknowledging receipt of your order (the "Order Acknowledgement"). This acknowledgement does not constitute acceptance of your offer; it is simply confirmation that we have received your order.
2.3 Acceptance and Contract Formation
A binding contract between you and us comes into existence only when we send you a further email confirming that your order has been accepted and is being prepared for dispatch (the "Dispatch Confirmation"). At that point, the contract is made and you acquire the right to receive the goods (subject to availability and payment clearance).
We may, at our discretion, decline to accept any order. Common reasons for non-acceptance include:
- The goods are no longer available or have been discontinued;
- We are unable to obtain authorisation for your payment;
- We have identified an error in the price or description of the goods;
- You do not meet eligibility requirements or we reasonably suspect fraud or unlawful activity; or
- We are unable to deliver to the address you have provided.
If we do not accept your order, we will notify you by email and will not charge you. If payment has already been taken, we will issue a full refund within 14 days.
2.4 Order Reference and Records
Each order will be assigned a unique order reference number. Please quote this reference in all correspondence with us. We recommend you retain copies of your Order Acknowledgement, Dispatch Confirmation and these Terms for your records.
3. Prices and Delivery Charges
3.1 Prices
All prices displayed on our website are in pounds sterling (GBP) and include Value Added Tax (VAT) at the prevailing UK rate (currently 20% for most goods). Prices are inclusive of VAT unless expressly stated otherwise.
The price you pay is the price displayed on our website at the time you place your order, subject to clause 3.2 below. Once we have sent you a Dispatch Confirmation, we will not increase the price (except in the rare circumstances described in clause 3.2).
3.2 Pricing Errors and Price Changes
We take care to ensure that all prices are accurate, but errors can occasionally occur. If we discover a pricing error after you have placed an order but before we have accepted it (i.e. before the Dispatch Confirmation), we will contact you to inform you of the correct price and ask whether you wish to proceed at that price or cancel the order. If you choose to cancel, or if we cannot contact you, we will treat the order as cancelled and refund any payment already made.
If a pricing error is discovered after we have sent the Dispatch Confirmation and the correct price is higher than the price you paid, we will contact you. You may choose to proceed and pay the difference, or cancel the order for a full refund. If the correct price is lower, we will charge you the lower amount and, if you have already paid, refund the difference.
We reserve the right to amend prices for future orders at any time, but such changes will not affect orders already accepted by us.
3.3 Delivery Charges
Delivery within the United Kingdom is free of charge. We do not impose any shipping or handling fees for orders delivered to addresses in the UK.
The total price you pay will therefore be the price of the goods (inclusive of VAT) only. This total will be confirmed to you at checkout before you complete your order.
4. Payment
4.1 Payment Methods
We accept payment by major credit and debit cards (including Visa, MasterCard and American Express where available) and such other payment methods as are displayed at checkout (which may include digital wallets and other secure payment providers).
Payment is processed securely by our third-party payment service provider. We do not store your full card details on our systems.
4.2 When Payment Is Taken
Payment authorisation will be sought when you place your order. Your payment method will typically be charged once your order is accepted and the Dispatch Confirmation is sent, or shortly thereafter. In some cases, authorisation and capture may occur simultaneously at the point of order.
You must ensure that you have sufficient funds or credit available to complete the transaction. If payment is declined or fails for any reason, we reserve the right to cancel your order.
4.3 Payment Security
All payment transactions are encrypted and processed in accordance with the Payment Card Industry Data Security Standard (PCI DSS). We will never ask you to send payment card details by email. If you receive such a request purporting to be from us, do not respond and notify us immediately.
4.4 Invoices and Receipts
A VAT receipt or invoice will be included with your goods or sent to you by email once your order has been dispatched. If you require a duplicate, please contact us quoting your order reference number.
5. Delivery and Timescales
5.1 Delivery Location
We currently deliver only to addresses within the United Kingdom. We do not deliver to BFPO addresses, the Channel Islands or the Isle of Man unless expressly stated at checkout. If you require delivery outside the UK mainland, please contact us before placing your order to confirm availability.
You must provide a complete and accurate delivery address, including postcode. We cannot be held responsible for failed or delayed deliveries caused by incorrect or incomplete address details provided by you.
5.2 Delivery Timescales
We aim to deliver your order within 3–5 working days from the date of our Dispatch Confirmation. "Working days" means Monday to Friday, excluding UK public holidays.
These timescales are estimates only and are not guaranteed. While we will make every reasonable effort to meet them, delivery times may be affected by factors beyond our control, including (but not limited to) courier delays, adverse weather, industrial action, customs procedures, or high seasonal demand. We will not be liable for any loss or inconvenience caused by late delivery, except as set out in clause 8 (Our Liability).
If your order has not arrived within a reasonable time (or if we have given you a specific delivery date and we miss it), please contact us and we will investigate.
5.3 Delivery Process and Signature
Goods will be delivered by our courier to the address you have provided. Depending on the courier service and the nature of the goods, you (or someone at the delivery address) may be required to sign for the delivery. If no one is available to accept delivery, the courier may leave a card with instructions for re-delivery or collection.
Some couriers offer "safe place" or "nominated neighbour" delivery options. If you choose these options, risk in the goods passes to you when the courier leaves them in accordance with your instructions.
5.4 Non-Delivery and Failed Delivery
If the courier is unable to deliver your order after making reasonable attempts, or if you fail to accept delivery when it is tendered, the goods may be returned to us. We will contact you to arrange re-delivery. We reserve the right to charge reasonable costs for re-delivery if the failure was due to your actions (e.g. you provided an incorrect address or were unavailable without notifying us).
If, after reasonable efforts, re-delivery is not possible, we may treat the contract as cancelled and refund any payment made by you, less our reasonable costs (including outbound and return shipping, and any restocking charges).
5.5 Risk and Title
The goods remain our property (we retain legal title) until payment has been received in full. However, risk of loss or damage to the goods passes to you on delivery. Once the goods have been delivered to the address you provided, you are responsible for any loss or damage, except where caused by our negligence or breach of these Terms.
Please inspect the goods on delivery. If the packaging is visibly damaged, please note this when signing for delivery and contact us immediately.
6. Your Right to Cancel (Distance Selling and Returns)
6.1 Statutory Cancellation Right (14 Days)
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a legal right to cancel your order within 14 calendar days without giving any reason. This is your statutory right of withdrawal.
The 14-day cancellation period begins on the day after the day on which you (or a third party nominated by you, other than the carrier) receives the goods. If your order consists of multiple items delivered separately, the period begins on the day you receive the last item.
To exercise your right to cancel within this 14-day period, you must inform us of your decision by a clear statement. You may use the contact details provided in clause 1, or any cancellation form we provide. You do not need to give a reason.
If you cancel within the 14-day statutory period, we will refund all payments you have made (including the cost of delivery, if any), without undue delay and in any event within 14 days of the day on which we are informed of your decision to cancel. We will make the refund using the same payment method you used for the original transaction, unless you expressly agree otherwise. You will not incur any fees as a result of the refund.
You must return the goods to us without undue delay and in any event within 14 days of informing us of your cancellation. Under your statutory right, you are responsible for the cost of returning the goods unless we have agreed to collect them or we have failed to inform you that you must bear the cost.
You are only liable for any diminished value of the goods resulting from handling of the goods beyond what is necessary to establish their nature, characteristics and functioning (i.e. beyond what you would be allowed to do in a shop). If you have used or damaged the goods beyond this reasonable inspection, we may make a deduction from your refund to reflect the reduction in value.
6.2 Voluntary Extended Return Period (30 Days)
In addition to your statutory 14-day right, we offer a voluntary, goodwill return period of 30 days from the date of delivery. This is a contractual right we grant to you, over and above your statutory entitlements.
If you wish to return goods between day 15 and day 30 after delivery, the following terms apply:
- You must notify us of your intention to return the goods by contacting us using the details in clause 1;
- The goods must be unused, in their original condition and packaging, with all labels and tags attached;
- You are responsible for the cost of return shipping;
- We will refund the price you paid for the goods, but delivery charges (if any were charged) will not be refunded under this voluntary return right; and
- Refunds will be processed within 14 days of our receipt and inspection of the returned goods.
This voluntary 30-day return right is subject to the exclusions set out in clause 6.4 below and does not affect your separate statutory rights under the Consumer Rights Act 2015 if goods are faulty (see clause 7).
6.3 How to Return Goods
If you wish to return goods (whether under your 14-day statutory right or our 30-day voluntary returns policy), please follow these steps:
- Contact us by email (contact@furnivo.shop) or telephone (447447205992) and provide your order reference number and details of the item(s) you wish to return;
- We will provide you with a return address and any further instructions (including, if applicable, a returns authorisation number);
- Pack the goods securely in their original packaging (or suitable alternative packaging) to avoid damage in transit;
- Send the goods to the return address provided, using a tracked and insured delivery service where practicable. You are responsible for the goods until they reach us, so we recommend obtaining proof of postage;
- Retain proof of postage and any tracking reference until your refund has been processed.
Full details of our returns process, including the return address, are set out in our Returns & Refunds Policy, which should be read together with these Terms.
6.4 Exceptions to the Right to Cancel
Your statutory right to cancel does not apply to certain types of goods, as set out in the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. These include (but are not limited to):
- Goods that have been personalised, customised or made to your specification;
- Sealed goods which are not suitable for return due to health protection or hygiene reasons, once unsealed by you after delivery;
- Goods which by their nature cannot be returned or are liable to deteriorate or expire rapidly; and
- Audio or video recordings or computer software if you have unsealed them after delivery.
If any item in your order falls into an excluded category, this will be clearly stated on the product page and confirmed to you before you complete your purchase. Our voluntary 30-day returns policy also does not apply to such excluded goods.
